A prenuptial or cohabitation agreement sets out in advance what happens to property, income and support if a relationship ends. Lawyers in this area draft and review prenups before marriage, postnuptial agreements during it and cohabitation agreements for unmarried couples. Typical concerns include protecting a business or family wealth, keeping inherited property separate, handling a second marriage with children from a first, and planning for couples who own homes in several countries.
The rules are national, and the weight given to an agreement varies a lot. Many civil law countries let couples choose a matrimonial property regime by notarial deed, and that choice is generally binding. In the US most states enforce prenups if there was full disclosure and no pressure. England and Wales treats a nuptial agreement as highly persuasive but not automatically binding. Cohabiting couples often have few default rights, which makes a written agreement more useful. Formal requirements, such as a notary or independent advice for each partner, are common.
Fees are usually fixed or hourly. A straightforward agreement can be a fixed fee, while cross-border cases with complex assets take longer. Each partner should normally have their own lawyer. Contingency fees have no place in this work and are banned in family matters in most countries. Notary fees come on top where a deed is required.
Timing matters. Signing just before a wedding can make an agreement easier to challenge, so many lawyers advise finishing weeks or months ahead. Before hiring, ask whether the lawyer handles agreements with an international element, which law will govern it, what disclosure is needed and how often the agreement should be reviewed. Then filter by country or city below.
